Fayetteville Police said Michael Anthony Herman III was driving a 2004 Toyota when he lost control of the vehicle, hit a sign, and then crashed the passenger side of the vehicle into a tree.

Herman was not seriously injured and left the scene. A passenger in the car, 18-year-old Charles Oatis Jr., was found unresponsive when emergency crews arrived.

A witness who called 911 said Herman did not leave immediately.

"No, he didn't run away, he didn't run away like that. He was like in shock. So he wanted to go get his dad. They came back," said Aubrey Morrison.

Oatis was taken to Cape Fear Valley Medical Center and placed on an assisted living device. He is currently listed in critical condition.

Authorities originally stated Oatis had passed away from his injuries, but later corrected their statement.

Herman was arrested shortly after the accident at his home on Rim Road.

He has been charged with driving while impaired, driving after drinking under 21, felony hit-and-run, felony injury by motor vehicle, reckless driving and driving without a license.

Herman was in the Cumberland County Detention Center under a $21,000 bond.
