Mother won't be charged in train accident

That Tuesday from Durham police.

An Amtrak passenger train was traveling westbound when it struck a white Ford Explorer sitting on the train tracks on Ellis Road at Angier Avenue just before 5:20 p.m. December 10.

Durham police said the driver of the SUV, Deborah Peaks Bingham, was stuck on the tracks in traffic as the warning lights and arms came down.

Her children, 9-year-old Calvin Brandon and 6-year-old Hassan Bingham, were thrown from the vehicle and died at the scene. Deborah Bingham was taken to the hospital and was treated for non life-threatening injuries. No one on the train was injured.
